Contract terms
Terms and conditions
These terms apply to orders through the Lightworks storefront and distinguish standard goods from genuinely personalised products.
Last updated 14 August 20261. Scope and contracting party
These terms apply to contracts for goods between the customer and Benjamin Nöst, handelnd unter Lightworks, Rorichmoorer Str. 76, 26802 Moormerland (“Lightworks”).
A consumer is a natural person acting mainly outside their trade or profession. A business customer is a natural or legal person or partnership acting in the course of its trade or profession.
Individual agreements take precedence. A business customer's conflicting terms apply only where Lightworks expressly accepts them in text form.
2. Offer and formation
Product presentation is not a binding offer. Items can be placed in the cart without obligation and entries can be checked and corrected before submission.
Pressing the button clearly indicating an obligation to pay submits a binding purchase offer. The contract is formed when Lightworks accepts it in a written order confirmation. A merely technical receipt notice expressly labelled as such is not acceptance.
If an order cannot be accepted, payments already received will be refunded promptly. There is no entitlement to acceptance of an order.
3. Language and contract record
Contract languages are German and English; the checkout language applies. Order data, the applicable document version, these terms and the cancellation information are sent with the confirmation on a durable medium. Registered customers can also view order information in their account.
4. Products and custom configuration
Descriptions, dimensions, materials, scope and variants follow the product page and order review. Natural wood may reasonably vary in colour, grain and structure; screens may display colours differently. Statutory remedies remain unaffected.
For Studio and personalised products, the configuration displayed and stored at order time controls, including map area, scale, format, material, accessories, text, symbols and pins. The preview is not a dimensioned technical drawing and map data may simplify or change relative to the real world.
Customers are responsible for spelling, addresses, coordinates and submitted text, and must have all rights required for submitted content. Lightworks may reject unlawful or technically infeasible configurations and contact the customer for clarification.
5. Prices and shipping
Due to the small-business VAT exemption under section 19 of the German VAT Act (UStG), no VAT is charged or shown. All stated prices are total prices; the shipping costs shown before the order is placed are added.
The final review states all price components for the order. Shipping depends on product, method and country and is shown separately before the order becomes binding. Obvious pricing or calculation errors do not bind Lightworks; the customer will be informed.
6. Payment
Only methods shown in checkout are available. Due date, authorisation and charge timing follow the method described there. A payment provider's additional terms apply only where validly incorporated and cannot limit mandatory consumer rights.
If payment fails or is reversed, Lightworks may withhold performance until payment is complete. Statutory default rights remain unaffected.
7. Production and delivery
Delivery area, method and estimated production or delivery time are shown on the product page or in checkout. Time begins once the contract is formed, agreed advance payment is received and all custom-production details are complete.
Partial delivery is permitted where reasonable and without extra shipping charges. Additional shipping caused by an incorrect address may be charged where the customer is responsible.
For consumers, transit risk generally passes only on delivery to the consumer or an authorised recipient. Statutory rules prevail.
8. Retention of title
Goods remain Lightworks property until the purchase price has been paid in full.
9. Cancellation right and personalised goods
Consumers generally have the statutory cancellation right for distance contracts. The separate cancellation notice provides details.
Under section 312g(2)(1) BGB, there is no statutory cancellation right for goods that are not prefabricated and are made according to an individual choice or clearly personalised. This covers genuinely personalised Studio products and standard products made customer-specific by a selected personal dedication engraving. Choosing ordinary standard variants such as size or material does not automatically remove the right.
Any applicable exclusion is identified for the affected item and before ordering. Statutory remedies for defects also apply to personalised goods. Customers habitually resident in Switzerland are voluntarily granted the same 14-day cancellation right for non-personalised standard goods under the cancellation notice.
10. Statutory remedies
Statutory remedies for defects apply. Consumers are asked to document visible transit damage with the carrier and inform Lightworks, but failure to do so does not restrict statutory rights. Business customers remain subject to statutory inspection and notification duties where applicable.
11. Liability
Lightworks has unlimited liability for intent and gross negligence, culpable injury to life, body or health, under product liability law, within an assumed guarantee and wherever liability is mandatory.
For slight negligence causing breach of an essential contractual duty, liability is limited to the typical foreseeable loss. Essential duties are those enabling proper performance and regularly relied upon. Liability for other slight negligence is excluded. These limits also apply to employees and agents.
12. Design and content rights
Copyright, trade marks and other rights in the shop, designs, software, previews and production methods remain with their owners. Buying a product does not transfer additional rights in design files or software.
The customer grants Lightworks the rights in submitted text, symbols and content required to perform the contract, document legal obligations and handle warranty claims, limited accordingly in time and scope.
13. Dispute resolution
We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration body.
14. Governing law
German law applies excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection under the law of their habitual residence.
Where the customer is a merchant, public-law entity or public-law fund, the courts at Lightworks' seat have jurisdiction to the extent permitted by law. Mandatory jurisdictions remain unaffected.
